Terms and Conditions

By continuing to use our services, you agree to these terms and conditions. These terms are entered into by and between you and BrilliantSaas Development Agency ("BrilliantSaas").

1. Services and Payment

  • We offer software development services on a project basis or through retainer agreements.
  • Payments for services rendered are due as specified in the service agreement, without refunds.
  • Project scope or service requests can be adjusted with mutual agreement. Additional costs may apply.
  • Service prices and offerings are subject to change with prior notice.

2. Communication

  • We may use your email or other means to communicate regarding project updates, service changes, and other relevant information. You can opt out of non-essential communications at any time.
  • Both parties must respond to emails or written messages within a maximum period of 24 hours.
  • Video or audio meetings, scheduled at the client's convenience, will be limited to a maximum of one per week. The rest of the communication will be conducted through messages, which may include images, shared videos, audio, or any means that facilitate communication.

3. Intellectual Property

  • All intellectual property rights in the software developed by BrilliantSaas for you shall belong to you, subject to full payment for the services.
  • By engaging our services, you grant us the right to use your project as a case study or portfolio example, unless otherwise agreed.

4. Use of Services

  • You agree to use our services in compliance with all applicable laws and regulations and not for any unlawful purpose.
  • Any misuse or abuse of the services provided may result in the termination of your agreement with us.

5. Liability

  • BrilliantSaas's liability in connection with the services provided shall be limited to 80% of the total amount paid for the services in the last 4 weeks under the agreement.
  • BrilliantSaas is not liable for delays or issues caused by the client's failure to respond to messages, complete questionnaires, or provide necessary resources such as mockups, logos, copywriting texts, domains, hosting platforms, or any other agreed-upon materials required to complete the project.

6. Service Quality and Guarantees

  • We strive to provide high-quality services and will work with you to address any dissatisfaction.
  • However, we do not guarantee uninterrupted or error-free service delivery.

7. Confidentiality

  • We are committed to maintaining the confidentiality of your project and any sensitive information shared.

8. Termination of Services

  • Either party may terminate the service agreement with written notice in accordance with the terms of the agreement.
  • The client may also pause the services at any time, as described on brilliantsaas.com.

9. Governing Law

  • These terms and conditions are governed by and construed in accordance with the laws of Portugal.

10. Amendments to Terms

  • We reserve the right to modify these terms at any time. Continued use of our services after such changes constitutes acceptance of the new terms.
